MakeARap respects the rights of artists and creators, and we expect our users to do the same. We respond to clear notices of copyright infringement under the US Digital Millennium Copyright Act (DMCA) and similar laws.
Reporting infringement
Send your notice to our copyright agent at support@makearap.com with the subject “DMCA notice”. Please include:
- your physical or electronic signature;
- a description of the copyrighted work you believe is infringed;
- the link to the material on MakeARap you want removed;
- your name, address, phone number and email;
- a statement that you believe in good faith the use is not authorised by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for the owner.
We remove or disable the material promptly and let the user who posted it know.
Counter-notice
If your material was removed and you believe it was a mistake or misidentification, send a counter-notice to the same address with:
- your physical or electronic signature;
- the material that was removed and where it appeared;
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
- your name, address and phone number, and your consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any judicial district in which MakeARap may be found), and that you will accept service from the person who sent the notice.
We forward the counter-notice to the person who sent the original notice. Unless they tell us they have filed a court action, we may restore the material in 10 to 14 business days.
Repeat infringers
We close the accounts of users who repeatedly infringe copyright.
False claims
Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages. If you are not sure whether something infringes your rights, consider getting legal advice first.
